This agreement is between: “Zilch Enterprises Pty Ltd ” of Kew East VIC, Australia, trading as “Zilch Formulas” or “Us” or “We” AND “You” means the consumer who is making purchasing transactions or interacting with us on our “Website” which is www.zilchformulas.com and all its affiliated pages and subdomains (eg: www.zilchformulas.com.au.)
You enter this agreement with Zilch Formulas when you purchase products through the website and every time you interact with the website or social media by commenting, uploading or downloading any material.
We reserve the right to amend this Agreement at any time without notification.
Disclaimer
Any purchases made on the Zilch Formulas website is subject that you have read the and agreed to the disclaimer on the website. A purchase on our website constitutes an agreement to our disclaimer, terms and conditions.
Website
We are dedicated to the highest level of customer service, however we cannot guarantee that the website will be available at all times. We may cease any part, or all of the website, at any time and without notification to you. We will not be responsible for any loss, cost, damage or liability that may arise as a result. The content is made to be as accurate as however the nature its content is general, and does not constitute as medical advice.
Purchase Transactions and Delivery
During purchase transactions, it is your responsibility to provide us with your real name and personal information as we require at the time of ordering.
Delivery estimates are provided by our courier companies. We do not guarantee delivery or shipment dates. Orders are shipped to the delivery address as entered by the customer when order is placed.
We will endeavour to deliver your order within the delivery time-frame indicated on the website and if there are any unexpected delays in fulfilling your order then we will send you an email advising you of the delay. We are not to be held responsible for any delays due to couriers/customs/postage services.
We will dispatch your order to the address that you have indicated. It is your responsibility to ensure that you provide the correct shipping address and somebody is available to receive that order in a reasonable time frame.
Payment
When using this website to purchase any product, you confirm that the credit/debit card that is being used is yours or that you have authorisation for use of that card. Your personal information may be shared with third parties when necessary authorisation processes by the card issuer are carried out. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
Payment details will show up as Zilch Enterprises on your bank statements.
Importation outside Australia
We cannot ensure that use and importation of our products into any country other than Australia or USA is authorised. If your delivery address is outside of these regions, or you use a delivery forwarder to ship the product to an address outside of these regions, then you are solely responsible for all tariffs and taxes that may be applicable in that country; and ensuring that importation, possession and use of the product is legal.
Intellectual property
All material on Zilch Formulas website including current and future registered and unregistered trademarks, trade names, business names, service marks, domain names, patents, inventions, processes, slogans, logos, emblems, registered and unregistered designs, images, graphics, layout, appearance, or all website literary works including print and copyright, is intellectual property owned by Zilch Formulas; and this intellectual property is protected. No intellectual property rights are transferred and no licenses are granted to any person, simply because they are using the website. A breach of intellectual property and copyright, includes without limitation to: Altering or modifying any of the code or the material on your website; causing any of the material of your website to be framed or embedded in another website; creating any derivative works from content which is available on your website; using the content of the website for any commercial purposes without permission.
Reviews and photos
Any reviews received by customers may be used on our social media platforms, website, and marketing. From time to time, these images and reviews may be used or shared by affiliated companies such as, but not limited to: stockists of Zilch Formulas, distributors, wholesalers, etc. At any time if you would like your pictures or review to be removed, please email us at info@zilchformulas.com and we will remove them from platforms owned by Zilch Formulas.

We do not accept responsibility for the acts or omissions of any persons who advertise on the website. This website may contain links to other websites and we do not endorse, provide any warranty or take any responsibility for any aspect of those websites or their content.
Malicious use of Website
You must not use the website to upload or transmit any material that is obscene, defamatory or illegal; infringes any third party Intellectual Property rights; incites hatred against, or disparages a person on the basis of their race, nationality, religion, political belief, sexuality, gender, age, health, disability or body shape; harasses, threatens or intimidates any person; constitutes a false or misleading testimonial on use of our goods or services; contains any Trojan horse, virus or other malicious code; or is illegal.
Jurisdiction
These T&Cs are subject to the law of Victoria, Australia. If a dispute arises then you will endeavour to resolve this matter by negotiation with us first. If you bring any legal claim against us then you must do so before the courts or tribunals of Victoria, Australia, or the Victorian Registry of Australian Federal Courts. We may bring any claim against you in either Victoria or in the jurisdiction where you are located.
